Terms & conditions
Buyer terms for purchasing authenticated designer pieces from the Encore Luxe shop — contract, payment, authenticity, delivery and 14-day returns.
Last updated 26 September 2026
These terms & conditions govern purchases from the Magento shop at shop.encoreluxe.co.uk. They are the buyer terms for shopping with us. Separate terms apply if you sell a piece to Encore Luxe.
The seller is Flair Furniture Ltd, trading as Encore Luxe, Old Delivery Office, Oldfield Lane, Heckmondwike, West Yorkshire, WF16 0JD. Company contact: hello@encoreluxe.co.uk, 01924 943540.
Contract formation
A listing on the shop is an invitation to treat. Your order is an offer to buy the named piece at the stated price. A contract forms when we send written confirmation that we accept the order (usually by email) and the payment method has been agreed. We may decline an order if the piece has already sold, if payment cannot be completed, or if we believe the order is fraudulent or incomplete.
Each listing is a single physical object. Once sold, the page may remain as an archive record; it is not available for a second purchase.
One-of-a-kind authenticated pieces
Every piece offered in the shop has been in our hands at Heckmondwike. A specialist inspects it against the house’s own references, and the listing carries that authentication note. Condition is graded honestly; wear that forms part of the piece’s life is described rather than hidden.
Pre-owned luxury is not brand-new retail stock. Minor marks consistent with age and use, and the absence of original packaging, do not by themselves make a piece defective when disclosed in the listing.
Price and currency
All prices are in pounds sterling (£ GBP) and include VAT where applicable unless a listing states otherwise. Delivery charges, if any, are shown before you place the order. We may correct obvious pricing errors and will notify you before proceeding.
Payment
Payment is currently accepted by bank transfer to the account details we provide after order confirmation. Card and PayPal may be offered when those methods are enabled on the shop; if they appear at checkout, the processor’s terms also apply.
Title to the piece remains with us until we receive cleared funds in full. We will not despatch until payment is confirmed, except where we expressly agree otherwise in writing.
Authenticity guarantee
Every piece in the shop has been examined at Heckmondwike. If a qualified independent specialist later disagrees with our authentication in good faith, we will make it right: repair, replace with an equivalent piece if available, or refund the purchase price. This guarantee sits alongside your statutory rights and the 14-day distance returns right below; it is not cut short by them.
Delivery
We offer insured delivery within the United Kingdom, or collection by appointment at the Old Delivery Office, Heckmondwike. Risk passes to you on delivery to the address you give us, or on collection by you or your nominated person. Timing estimates are indicative; they are not guaranteed delivery dates unless we confirm one in writing.
Please inspect the packaging on arrival and tell us promptly if it appears damaged. Full detail is on our insured UK dispatch page.
14-day distance selling returns
If you buy at a distance as a consumer, you may cancel within 14 days of receiving the piece, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
To cancel, email hello@encoreluxe.co.uk or write to us within that period. You must return the piece within 14 days of telling us, in the condition it left us, with any accessories supplied. You are responsible for the cost of return unless we agree otherwise or the piece was defective or misdescribed. We recommend an insured carrier and will provide a returns note on request.
We will refund the purchase price (and standard outbound delivery you paid, where the law requires) within 14 days of receiving the returned piece or proof of return, whichever is earlier. We may reduce the refund if the piece’s value has diminished because of unnecessary handling beyond what was needed to establish its nature and condition.
See also our dedicated page. The authenticity guarantee above is separate from this cooling-off right.
Risk and title
Risk in the piece passes on delivery or collection as set out above. Title passes only when we have received cleared payment in full.
Liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English consumer law, including your rights under the Consumer Rights Act 2015.
Subject to that, we are not liable for loss of profit, loss of business, or other indirect or consequential loss, and our total liability arising from any contract for a piece is limited to the price you paid for that piece (including delivery charges paid to us for it). This limit is intended to be fair and reasonable for a boutique sale of authenticated pre-owned luxury.
Guest checkout and accounts
Guest checkout is available. Store credit from a sale to us can only be redeemed from a signed-in account, on the basket, before you pay. Buying from the shop is separate from selling to us.
Governing law
These terms and any contract under them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply where you live in the UK.
